Terms of Service

By creating an account or using Zovaty, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the service. We may update these Terms from time to time. Continued use after changes become effective constitutes acceptance of the revised Terms.

Zovaty is an AI website builder that helps you generate, edit, and publish websites. The platform may also include free developer tools, templates, publishing features, and related products described on our website. Some features are in beta and may change, be limited, or be discontinued without prior notice.

• You must provide accurate account information and keep your credentials secure.
• You are responsible for all activity under your account.
• You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the service.
• We may suspend or terminate accounts that violate these Terms or pose a security risk.

When you use AI features, prompts and context you provide may be sent to third-party AI providers to generate output. You are responsible for reviewing, editing, and publishing AI-generated content before use.

• AI output may be inaccurate, incomplete, or inappropriate. Do not rely on it as professional, legal, or financial advice.
• You retain ownership of content you create, subject to third-party rights in any underlying materials.
• You grant us a limited license to host, process, store, and display your content solely to operate and improve the service.
• You must not use AI features to generate unlawful, harmful, or infringing content.

Certain AI actions consume credits from your account balance. Credit costs, allowances, and availability are described on our Pricing and Billing pages and may change.

• Credits are deducted when qualifying AI actions complete successfully, as described in the product.
• Credits have no cash value, are non-transferable, and are not legal tender.
• We may adjust credit pricing, allowances, or consumption rules with reasonable notice where practicable.
• Unused credits may expire or reset according to your plan or purchase type.

Paid subscription plans (where available) are billed on a recurring basis through our payment provider, Lemon Squeezy, unless canceled. Subscription benefits, including monthly credit allowances, are tied to an active paid plan.

• Prices and plan features are listed at checkout and may change for future billing periods.
• You authorize recurring charges until you cancel through the customer portal or as described in our Refund Policy.
• Downgrades or cancellations typically take effect at the end of the current billing period unless stated otherwise.
• We do not guarantee uninterrupted access to any specific feature tier.

One-time credit packs may be offered as a top-up to your balance. Credit packs are separate from subscription allowances unless explicitly stated. Refund terms for credit packs are described in our Refund Policy.

You agree not to:

• Violate applicable laws or third-party rights.
• Upload malware, spam, phishing content, or illegal material.
• Attempt to access other users' accounts or data without authorization.
• Abuse, scrape, reverse-engineer, or disrupt the platform or its infrastructure.
• Circumvent credit limits, billing controls, or security measures.
• Use the service to build sites primarily for fraud, harassment, or deception.

You may stop using the service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the service. Upon termination, your right to use the service ends. Provisions that by nature should survive (including limitations of liability) will survive termination.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT AI OUTPUT WILL BE ACCURATE OR SUITABLE FOR YOUR PURPOSES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZOVATYAND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY APPLICABLE LAW.
